2. Scope and Acceptance
These Terms and Conditions (“Terms”) govern your use of the Data Projector platform, including the website, applications, and all related services (the “Platform”). By creating an account, logging in, or otherwise using the Platform, you agree to these Terms. If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity. These Terms apply in addition to any separate service or subscription agreement you have with us.
In the European Union and in Finland, these Terms operate in accordance with the Finnish Consumer Protection Act (Kuluttajansuojalaki), the Finnish Act on the Provision of Digital Services, and applicable EU directives (including the Consumer Rights Directive 2011/83/EU and the Digital Content Directive 2019/770 where relevant).
3. Description of the Platform and Services
The Data Projector Platform allows businesses (including accounting firms, data management companies, and service providers) to manage multiple client companies in one account. You can connect data sources (e.g. Google Sheets, Excel, databases), process and transform data, and access reports and analytics per company. Services are provided as described in your selected plan and in accordance with our then-current documentation and policies.
4. Account Registration and Use
You must register for an account to use the Platform. You agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us without undue delay of any unauthorized access or breach. You may not create an account if you are under 18 or if you are prohibited from using the Platform under applicable law.
5. Acceptable Use
You may use the Platform only for lawful purposes and in accordance with these Terms. You must not: (a) use the Platform in any way that violates EU or Finnish law or the laws of your jurisdiction; (b) upload or process data that infringes third-party rights or that you do not have the right to use; (c) attempt to gain unauthorized access to the Platform, other accounts, or our systems; (d) interfere with or disrupt the integrity or performance of the Platform; or (e) use the Platform to build a competing product or to reverse-engineer our services beyond what is permitted by mandatory law. We may suspend or terminate your access if we reasonably believe you have breached these Terms.
6. Contract Formation and Right of Withdrawal (Consumers)
B2B: A contract is formed when you accept our offer (e.g. by completing registration and/or subscribing to a plan) and we confirm acceptance in accordance with our processes.
Consumers (B2C): If you are a consumer within the meaning of the Finnish Consumer Protection Act or the EU Consumer Rights Directive, a contract is formed when you accept these Terms and our offer. You have the right to withdraw from a distance contract within 14 days without giving a reason. To exercise this right, inform us by email or via our contact form before the end of the 14-day period. If you have requested that we begin the supply of digital content or services during the withdrawal period, you may be required to pay for what was supplied up to the time you informed us of your withdrawal, in accordance with applicable law.
7. Prices and Payment
Prices are displayed in the currency stated (e.g. EUR) and include applicable VAT where required by EU and Finnish law. Payment terms are as set out in your plan and any invoice. You may cancel your subscription as permitted by your plan; cancellation typically takes effect at the end of the current billing period. Refunds are handled in accordance with applicable consumer and contract law.
8. Your Data and Multi-Company Use
You may use the Platform to manage data belonging to multiple companies (e.g. client companies). You are responsible for ensuring that you have the legal right and any necessary consents to upload, process, and store that data on the Platform. You must comply with all applicable data protection laws (including the EU GDPR and the Finnish Data Protection Act (Tietosuojalaki)) when providing us with personal data. Our processing of personal data is described in our Privacy Policy.
9. Intellectual Property and Licence
You retain ownership of your data and any content you upload. We retain all rights in the Platform, our software, designs, and methodologies. We grant you a limited, non-exclusive, non-transferable licence to access and use the Platform in accordance with these Terms and your plan. Reports and outputs generated for you are provided for your use under the service agreement; ownership of underlying data remains as stated above.
10. Complaints, Defects and Statutory Rights
If you are a consumer, you have statutory warranty and remedy rights under the Finnish Consumer Protection Act. You must notify us of any defect or complaint without undue delay. We will address defects in accordance with applicable law. For business users, our liability is subject to the limitations below except where mandatory law does not allow it.
11. Limitation of Liability
To the fullest extent permitted by mandatory law: we are not liable for indirect, incidental, consequential, or punitive damages, or for loss of profit, data, or business opportunity. Our total liability in connection with the Platform or these Terms is limited to the amount you paid us in the twelve (12) months preceding the claim (or, if no amount was paid, to a maximum of one hundred euros (100 EUR)). For consumers in the EU/EEA, nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under Finnish or EU law.
12. Data Protection
Personal data is processed in accordance with our Privacy Policy, the EU General Data Protection Regulation (GDPR), and the Finnish Data Protection Act (Tietosuojalaki 1050/2018). We act as a data controller for account and platform usage data and, where we process personal data on your instructions (e.g. data you upload about your clients), as a data processor in accordance with our data processing terms and applicable law.
13. Applicable Law and Dispute Resolution
These Terms are governed by the laws of Finland. For consumers resident in the EU/EEA, mandatory consumer protection provisions of your country of residence may also apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Disputes may be brought before the courts of Finland. EU consumers may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr. The Finnish Consumer Disputes Board (Kuluttajariitalautakunta) and the Market Court may be competent in matters falling within their jurisdiction.
14. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated (e.g. by email or a notice on the Platform) with reasonable notice. The “Last updated” date at the top of this page will be revised. Continued use of the Platform after the effective date of the new Terms constitutes acceptance where permitted by law. If you do not agree, you must stop using the Platform and may terminate your account in accordance with your plan.
